These Terms of Service ("Terms") govern your access to and use of Formula Car Stunts, together with any related games, websites, applications, and services (collectively, the "Service") provided by Chengdu Wenfan Technology Co., Ltd. ("Wenfan Technology," "we," "our," or "us"), with its principal business address at Room OL-03-202311021, No. 198 Ning'an East Road, Wan'an Subdistrict, Tianfu New Area, Chengdu, Sichuan 610000, People's Republic of China.

By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must immediately discontinue use of the Service.

4. User Conduct

5. Virtual Items and Purchases

The Service may include virtual currency, virtual items, subscriptions, upgrades, or other digital content.
Unless otherwise stated, virtual items and digital content are licensed to you and are not sold or transferred to you as property.
Virtual items have no cash value and may not be exchanged for real-world currency or other monetary value unless expressly permitted by the Service.
Except where required by applicable law or applicable platform policies, purchases are final and non-refundable.
We may modify, suspend, replace, remove, or discontinue virtual items or digital content at any time, subject to applicable law.
You may not sell, transfer, trade, or otherwise commercially exploit virtual items unless expressly authorized by us.

6. Subscription Services

Certain features of the Service may be offered through recurring subscription plans.
If you purchase a subscription, it may automatically renew unless you cancel it before the applicable renewal date.
You authorize the applicable payment provider or platform to charge your selected payment method for applicable subscription fees.
Subscription management, billing, cancellation, and renewal may be handled through Apple App Store, Google Play, or another authorized platform.
The terms and conditions of the applicable platform may also apply to your subscription.

7. Refund Policy

Except where required by applicable law or applicable platform policies, purchases are non-refundable.
Refund requests for purchases made through Apple App Store, Google Play, or another third-party platform should generally be submitted through the applicable platform.
We may review refund requests where appropriate and may deny requests involving fraud, abuse, unauthorized transactions, or violations of these Terms.
Nothing in these Terms limits any mandatory refund or consumer rights that cannot legally be excluded.

8. User Content

Certain features of the Service may allow you to submit usernames, messages, images, gameplay content, feedback, or other materials ("User Content").
You retain any ownership rights you may have in your User Content.
By submitting User Content through the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, display, distribute, and otherwise use the User Content as reasonably necessary to operate, maintain, improve, and promote the Service.
You represent and warrant that you own or have all necessary rights and permissions to submit the User Content and grant the rights described above.
You must not submit User Content that violates applicable law or infringes the rights of any third party.

Nothing in these Terms grants you ownership of or any intellectual property rights in the Service.

We shall not be responsible for losses resulting from circumstances beyond our reasonable control, including failures of third-party platforms, networks, telecommunications services, or other infrastructure.
Our total aggregate liability arising out of or relating to the Service or these Terms shall not exceed the greater of (a) the amount you actually paid to us for the Service during the six (6) months preceding the event giving rise to the claim, or (b) the minimum amount required under applicable law.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

To the extent permitted by applicable law, you agree to indemnify and hold harmless Chengdu Wenfan Technology Co., Ltd., its affiliates, directors, officers, employees, licensors, service providers, and partners from and against claims, damages, liabilities, losses, costs, and expenses arising out of:

Your misuse of the Service;
Your User Content; or
Your violation of applicable laws or the rights of any third party.

We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to reasonably cooperate with us.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the People's Republic of China, without regard to conflict of law principles, except to the extent that mandatory laws of your jurisdiction provide otherwise.

Any dispute arising out of or relating to these Terms or the Service that cannot be resolved informally shall be submitted to the competent courts in accordance with applicable law.
